I have got a PM from another IV member whose 485 got denied yesterday because of 140 revocation. He switched the job after 180 days and sent AC21 docs as well. He is willing to share his ordeal with us.
Are we sending personal exp of the ppl affected along with the letter ? I guess, it makes perfect sense to send some real 485 denial examples.

I don't think this is a pattern, its probably specific just to the lender you were working with.
Frankly speaking the lender has the right to deny you the loan for whatever reason they feel is risky. So no point arguing with them.
Try another lender and hope it works.

I got my EB2 Labor certified today, and now my lawyer is preparing EB2 140 as an interfile into my existing EB3 485.
Is this recommended or should we do regular premium 140 and request date porting once its approved?
If we do decide to do interfile now during 140 application. Is it advisable to do premium processing?

If only wait times were as little as 2 yrs and 7 yrs...I might not even be fighting!!!

This is not true in most cases. The F1 might be for 2 yrs minimum + 1 year EAD + at least 2 yrs on H1B before the GC process starts. Then its 7+ years...
So overall, we are talking 10+ years to get permanant residency in a majority of cases.

The important thing is, not all BEC cases are alive today. Most people moved on to PERM. On the flip side, some newbies took advantage of substituted Labor, but I am guessing the count is not very high.
My employer applied for labor for 8 of us in our organization of 50 ppl. This is in the middle of 2003. I am the only one left at this point as the rest of them moved to different employers or got GC through their spouse. Also, I know for a fact that those labors were not substituted. This may have happened else where too. So, i guess the total I-485 applicants will be around 400K including dependants and won't be as high as being speculated every where.

66K plus 60K still only makes 126K, do they still have another 20K or so? How does the math tally here?
I think this all boils down to them wanting to clear the 485 backlog without accepting any more 485s all while not wasting any visa numbers for this year.
In an effort to juggle all these issues, they screwed it all up.
Bottom line is they want to streamline the system such that they don't have "unapprovable" 485s in the system. They have caught on to the way the lawyers and us legal immigrants were filing 485s to get our foot in the door then sitting tight for eons. They simply don't want that. They either want you here on a visa or on a green card straightforwardly. Thats what I am getting from all this.

Oh yeah...I've read that report. Dude just walk out if u dont like the process. Nobody is stopping u. Do u think things are faster in the country u came from? But when u come to another country u want things to happen like that. Yes 7 years is slow. But if millions keep coming into this country what can the USCIS do? Its clearly an overflow which they cant handle. Before u give a red think twice. Read clearly what one is trying to say. I agree with IV's fight for speedening of the process. But to blame the USCIS and to ask for a change in management is too much. We have NO RIGHTS WHATSOEVER to ask for that.

4. Let's talk about corruption. Where on earth is there no corruption? Whereever human beings are, there is corruption. 100%. It's here in the USA, its there in Japan, its there in Gulf. Everywhere. I am not saying corruption is good but is inevitable.
If you say, US thinks that because these guys are from India where corruption is to the core, and these guys have half the facilities (back home) that this country provide and hence deserve a broken immigration system that screws up their life, then my friend, this country is no better than any other country on this earth for being so mean. And, for that reason, if you ask me to get out of this country, I would like to say, humbly, that is none of your problem. If yes, ask every US organization that is trying to exploit the business potential in India to get out from India. When the last US business leaves India, I will leave this country.

Many of the H1B's are so involved in their work , they really donot follow their green card procedure and pressure their employers for better deal on filing their papers even when they have the chance.
New H1B's coming into the country should be given some guidance on the permanent residency process so that they donot end up like many of us in the forum waiting for years to get their residency.

Well said. On top of all this, there is a huge social pressure on NRIs from Indian parents/relatives to buy a property in India. It goes like this, if Hari, Babu and Kanwal all have it, why don't you buy something in Delhi as well. Now builders have started talking in terms of crores. You call them and ask the price, they would say "point six", means zero point six crores (for 1200 sq ft 2 BHK). There is no way on this earth someone should pay that much for 1200 sq ft in Noida/Delhi/Anywhere in India.
My advise, let people, relatives say what they want to say. This market is bound to come down. Just wait and see. Thank you.

First thing any developer does is to put up a website with some pretty pictures of layout and details like floor plan, location etc. This is the first step in attracting NRI's, he told me when he talks to NRI's, the first question they ask is the URL of the project. No wonder, most of the RE developer in recent times have a website, some of the website are a joke with absolutely no details and the rosy pictures of moon, lakes, birds, parks etc :-))
80% of his customers are NRI's, 10% are local goonda's/politician and rest 10% are common people...I was surprised to hear that some NRI's have bought/booked plots just by looking at the website and remitting money from USA...what happened to old school days of personally visiting, checking paperwork,Vaastu, getting opinions of relatives/friends before buying anything...what is the hurry here is beyond me???
I feel, this whole RE market in INDIA is a scam where RE developers are playing a game and targetting NRI's who are easy a prey...

America has always been a favorite destination for immigrants. In the past, labor jobs were abundant and there were enough immigrants to do those jobs. This mutual dependency contributed to the growth of the United States making it the fastest growing industrial nation in the world. Things have changed, labor immigrants have been replaced by high-tech and skilled immigrants, but two things have not changed. 1. America depends on immigrants to sustain growth and 2. Immigrants come to America to fulfill their dreams. This 300 year old interdependence is very important yet under appreciated by the lawmakers.
Skilled workers of foreign nationality are well educated, creative and ambitious individuals. They act as a �steroid� for the nation. They charge the nation with prosperity and growth. Generally countries depend on their younger generation and hope that they will become highly productive and good citizens contributing to the growth of their nation in future, however only few countries are blessed with the strong stream of immigrants with highly desirable qualities to make progress today, not tomorrow. It seems America is highly blessed in that regard. But unfortunately the lawmakers don�t seem to recognize how fortunate their country. Following facts support my observation:
1. World has entered information and biotech age. India and China has the biggest technological talent pool
waiting to settle down in USA, yet the immigration quota for these countries is locked to extremely small
and fixed number for decades due to half-century old laws. The laws does not take reality into account.
2. In the days of online stock trading, visa processing is still done at extremely slow pace.
3. The positive impact of immigrants has been taken for granted.
4. Immigration is considered a charity rather than an important factor in country�s growth. The attitude is not right.
If such ignorance continues in the United States following will happen:
1. Innovation will slowdown. It has already begun.
2. Technology companies will migrate to India and China.
3. Large scale outsourcing will occur for technological and knowledge based jobs.
4. Stock indexes will move south, as there won�t be many attractive places to invest money. High profits normally come from high growth companies and today�s high growth companies come from technology sector.
5. Tax revenues will decrease, which will affect all government activities including defense and public education.
6. The effects of illegal immigration will become severe as American�s will compete for low wage �blue collar� jobs as a result of outsourcing.
7. Severe retrogression in immigration will not allow skilled workers to settle down or adapt to ever changing skills market. It will hinder the growth of each skilled worker due to lack of long-term planning, long-term investments and developments. These people will not be able to plant the trees that can reap the fruits for generations to come.
8. The effect of not having skilled immigrants in the country will not be zero , but it will be negative and counter-productive as most skilled workers will go back to their home country and instead of contributing to the growth of America , they will compete.
9. National moral level continues to decrease as more American citizens are going into jails than good foreign nationals coming in!
All these effects will be slow in the beginning, but will be visible when it will cross the �tipping point�. A place from where there is no return.
The solution:
Remove the limit on immigration quota for technology professionals for 5 years to solve current retrogression crisis. There after update the quotas (increase or decrease) every year to keep delays constant at 1,2 and 3 years for EB1,EB2 and EB3 categories respectively.
In my view, 5 million well educated and talented legal immigrants are always better for the country than 5 million illegal immigrants. Its better to rely on technology to improve American life style than on illegal immigrants to do cheap labor.
