Hi
I have a question regarding my spouse who is on H4 visa.she has real experience in India for 5 years. One of the company who does some projects did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) Employer is saying she has to go out of the country to get the visa in order to work.
2) Apply for change of Status while staying in USA. Employer saying that there are chances of getting an RFE during that process. Is there any Premium process in Change of Status processing.
which one is advisable?
Can any one please suggest.

I am doing 245i myself. I send I485 for AOS in late Sept, 2010. Had fingerprints done on Nov 3rd. I haven't heard anything from them since October so I dont know if everything is okay.

Dont go by these dates - they are only processing dates. Go to this website for scheduling appointments:

You can only schedule appointments 6 weeks in advance.
By the way, does anyone know the approximate time daily that these appointment slots open up. I remember this used to be around 6am a couple of years back.

Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit. California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. In some instances, the state has employed outside counsel at hourly rates that reach $450 even while most of its in-house lawyers earn less than half that. Rates can be much higher, if the suits require private attorneys having a particular expertise.
Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs. The corrections department is seeking the additional help despite having about 80 lawyers of its own to handle a gamut of cases, with about a dozen of those assigned to prisoner-filed litigation.

I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.

Well, if you leave your co. now and also want your GC then:
Your H1 period will be over after 6 years irrespective of the I-140 from the old co.
GC: You do have to start from scratch.
However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

We have received our EAD cards without having Finger Print done. We have received FP notice and scheduled for the next week but received our EAD cards.
EAD cards says "No Finger print available" on the right corner. Will this cause any problems?
