Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

Hello,
My firm is about to start greencard processcing for me and this is the first time that they are undergoing this process. They are searching for letter templates which decribes the employee eligibility and responsibilies in the firm and why they want to recommend greencard for this perticular employee. If anybody can upload such kind of templates/documents, that would be of greater help.
Thanks.

Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)

Greetings,
I recently came across this site looking for information, then stumbled upon this contest and thought I'd drop an entry. This was drawn with the Brush tool in Adobe Illustrator.

Cousin of my friend got an email that his card production has been ordered.
He falls in EB3I (PD Aug. 2005). I could not believe it but my friend told me that
EB3I would see significant movement in coming months.

Let's resume our journey along the road where the arts intersect with America's dysfunctional immigration system. (Previous blog stops en route are posted here and here.) Two weeks ago, USCIS made news when it reportedly held up the approval of a visa petition for America's Got Talent judge, Piers Morgan, thus requiring Larry King to extend his term as CNN evening host until November. Today, we learn from The New York Times that a U.S. consular officer apparently caused the renowned German director Peter Stein to withdraw last July from a major Metropolitan Opera production of Boris Godunov, an operatic...

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

My company and lawyer refuse to talk to me or email me back.
I sent my completed package to the lawyer 2 weeks back, and I have not heard back from him.
The initial draft needs to be sent back by the lawyer for signatures and then the file can go out.
How do I hadle the situation?

Nextgov.com reports: The Homeland Security Department plans to establish a database of immigration data that will identify fraud in applications for benefits, and provide information to intelligence and law enforcement agencies. DHS will create a mirror copy of multiple databases the Citizenship and Immigration Services uses to award federal benefits to immigrants and nonimmigrants and develop a single user interface employees use to access the stored information, according to a notice the department published in theFederal Register on Wednesday. The Citizenship and Immigration Data Repository System of Records, which will include real-time updates and a search engine, will allow officials...

I came in 2003 on an H4 visa with my parents who were on H1B, I was 17 yrs old at that time. I then got my status changed to an F1 in 2004. I completed my bachelors and have been accepted into a masters program on a scholarship. I wanted to visit India, however I would like to know the risk involved in doing so. Would I still be at risk of not getting a f1 VISA in India even if I carry my approved F1 petition? Please advise..Thanks..

My attorneys screwed up and filed my I140 under the wrong category. (EB3 instead of EB2). They refiled PP but without the original Labor cert attached. My PP application is not approved yet.
I called a couple of weeks ago and they told me they wont do PP because the original labor cert was not attached.
I Emailed them yesterday and this is their reply:
'This petition has been assigned to an officer, but no decision has been made.'
Does this mean anything? meaning is it close to being approved??
Thanks much!!

I just received an 3 year h1-B extension based on an approved I-140. I had only 2 years left of 6 year h1 limit but because I have an approved I-140, I got one more year.
I attached my approved I-140 copies along with H1B extension application but the Alien number A# on this new H1-B extension approval is different than what I have on I-140 approval notice. Actually its a typo, instead of A 08 it A 008 and because of one extra zero the last digit is lost.
Is this a matter of concern? Please help.

Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

Hi,
I need some clarification. One of my friend confued me.
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.
Thanks in advance.
