Hey.
Im new to photography and am looking into photography for local music venues.
I have a D40 with its standard 18-55mm lens but I'm looking for a lens with a better aperture.
I am looking to get the Nikon 55mm f1.8 which is around �80.
As this is not an AF-S lens and can not focus automatically, will it sitll work with the D40 if I use manual focus?

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

Hi,
I know your time is very precious and not to waste.
My issue is - I came to US as a programmar/analyst in Aug' 2005 with my B.Commerce (3years) and Master of Computer Applications (completed my 3years masters by 2003) in India. My H1 company in March'2008 applied for PERM/I 140 through EB3 (as a professional) recently they came back to me that my I140 got denied due to educational evaluation difference and need to reapply again through a new lawyer as EB3 - unskilled - system support engineer.
Is this really require to go through the new lawyer to restart the GC process? - and this costs me to lose my priority date - almost 2 years
If yes, how are the chances to get the perm/I140 if I reapply through the same H1 company ?
Please find the denial docs and remember that I have to go for H1 extension by Aug'10 ( as I complete 5 years on my H1).

Hi. I am a Canadian Citizen that was offered a Management job in US.
I would appreciate any advice in regards the best way to ensure a LONG stay in US. The company wants to start with a TN.
Strategy #1:
To stay under TN and keep it renew it for a long term �. 10-20 years. The risk is that the guys at the border will say no at some point; however I wonder if I can request an appeal since there is no limit per TN rules.
( are there any cases that have stayed that long?)
Strategy #2:
Start with a TN then file an H1b and wait for the Labor of certification to be approved. If I do not hear anything in 1 or 2 years; change to TN to revise the strategy�. in order to avoid consuming the H1b 6 years lead time allowed and try again later.

I was keep observing the PERM approval rate trend for the past one year. Approval rate is very slow. But it is suddently jumped since last month. Looks like it is a good time to start filing another labor. I am in the same boat. Trying for a new employer for EB2.

Meanwhile the client where I am working has offered me full time position. Can I join this client on H1 and ask my current employer to continue my GC process and send AC21 on H1 after 180 days?

I guess that should be OK. Only H1B rules require one to be continuously earning. On EAD, if you have a potential employer who is willing to hire you after your GC is approved, you can remain without regular paychecks.
I know of the guys, who actually availed unemployment benefits on EAD, and yet got their GCs. At least sitting without regular paychecks is better than that.

(1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.
(2) On the other side, I may not have worry as my Labor was filed in year 2003.
Any Clarifications?

My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?
