I think you have the wrong information. Senate is not ready to vote on it yet. S 2198 which is a part of PACE and holds relevance to the employment based immigration is still in committee hearings.

If your 140 is approved the chances of 485 denial are quite remote. however most attorneys recommend that you try to stay on H1 as much as possible

I have a copy of Nolo Fiance and marriage Visas and in the section on I130 it says that my copies of G-325A must be filed in four copies printed on differently colored paper (white, green, pink and blue).
A) Is this really necessary?
B) If yes, I have actually bought paper in these colors. Does it have to a particular pink, blue, green etc?
C) The pages in the PDF are actually named
1) Ident.
2) Rec. Br
3) C.
4) Consulate
Which color matches which index? E.g. is the Ident one supposed to be white, blue, pink or green?
Hope someone knows about this.

Hi,
My employer filed for I-140 and I-485 last year July. My I-140 got approved with a labor converted from RIR.
I want to know the priority date in the approved I-140. But the employer is not giving me copy of I-140. I called USCIS and they say they cannot give the information to be.
How do i get my priority date now?
I have I-140 and I-485 receipt numbers.
Can you find it thru I-485 receipt number?

Dear experts/Attorneys,
Please help me. My EB2 priority date in 21Nov 2007. My I 140 is approved and yet to file for I 485. Now at work I have promotion offer from Sr developer to Team lead. Technologies I work for won't change, but I have to change my work location to different state in this case
do I have to file for PERM and I 140 again?
If I have to file 140 can I retain priority date?
Is there any other option for me to escape PERM refiling other than not accepting promotion :)?
Your advice is greatly appreciated.

We should also ask IV to fight against staying same or similar job position when using EAD or AC21. In a way that is totally against American competitive spirit and reward the bright spirit. Think about this way when some body is capable of climbing the ladder and able to provide great service to the company why can not he has been given promotion in the same field?? remember there is always somebody out there to abuse the system.... that is where the regulation should come into picture.

Hi,
My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.
Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

I have a I-485 pending with a LIN# and in the NEW instructions there is a lockbox for "I-485 and MSC" combo and a separate filing address for I-485. I'm confused about where a "I-485 with a LIN#" combo (my case) should be sending his EAD renewal documents over to? (Refering to pages 8-10 of I-765 instructions).

if some key decisions made.
Called IV, But the person who answered was busy answering similar questions from other member.We don't want to waste precious time of IV leaders by calling indvidualy.
If someone who attended can summarize for the benifit of those who missed, It would be great.
Also does members of other nationalities(non Indians) also attended the conference call.. Hopefully IV is striving to become voice of all EB GC aspirants. Everyone will gain from joint effort and IV will have resources to do meaningful things.

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129 and I worked part-time on a full-time LCA and I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.
