USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. Shouldnt be an issue as GC can be for a future job.....For H1 stamping, your current job requirements and title should be same as the requirements/title on your H1 petition/LCA....

Hi All,
This is my scenario.
1) I have an approved I-140 from my future employer company and the priority date is may-2003 (EB3).
11) I have filed my 485 and 140 concurrently in august EB2 category from my current employer. The priority date of my labor is nov-2006.
Please provide me your guidance can i use my approved 140 PD (may-2003) in my filled 485.

No, the H1 6 yrs period will apply only when for the period when your Payrolls where generated using H1 visa.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. To retain the PD, you would need the copy of the I140. Without that, there isn't much that can be done when you switch companies to keep your PD.

Hello,
I am on H1B , This is my 5 th year in US on H1B . My Initial Visa Stamping got expired . I changed from company A ( visa stamped ) to Company B, Currently I am H1B Extension ( I797 ) with out Visa . My wife and kids are with me on H4 (same as my case , old Visa expired now on extension of H4). They want to travel to India this summer . They need a Re entry Visa .
My Questions
Since I am(primary applicant) not going, Can they ( H4)go for stamping with my I797 extension papers with primary applicants (H1) Expired Visa ?
Appreciate your suggestions .

Hi.
My Wife is currently in H4 Visa and in US now. She has total of 11 years IT experience. She lastly worked with a Company X from May 2004 to May 2008 for about 4 years. Currently she is not an employee of Company X and also not working anywhere.
If the same Company X gives an US offer, Is it possible for the Company X to file L1 visa for her so that she can start working for that company immediately ? ( I have read in immigration forums that the L1 Visa Eligibility is that the person should have worked for that company for atleast 1 year within the last 3 years)
Experts, Can you pls give your opinion and suggestion on this ? If so, how long the process takes place for transfering from H4 to L1 visa ?

On March 17, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Eventhough I did not get notice yet by mail I am little confused and concerended with their message, I have couple of questions
1) Does this really means my AOS application is approved? Is there anything else I should do?
2) what is ADIT processing that they are referening to?
Any thoughts or experiences from the gurus here is really appreciated.

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?
