Comp A (A Consulting Firm)applied for H1-B in April 2009 thru consular Processing and got approved. I worked for Client X in the month of April but lost my job in a week itself.(thus I dont have any pay Stubs from Comp A)Since Comp A was not able to find me a job. I found A full time job in Comp B in June 2009 , I somehow convinced Comp B to hire me as a contractor as I already have my H1-B approved thru Comp A. Thus from july 2010 I started working for Comp A again as my employer and Comp B as its Client. I am planning to go for VISA stamping in Dec 2010. My Question is
1) If they Ask for my Tax Returns and W2 for 2009 what should I answer as I just have my W2 frm Comp B
2) would there be a question of something like why havent I've been working for Comp A Since my H1 approval.
Please advice. I appreciate any kind of answer

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

G4 is not a dual intent visa. She won't able to travel till she gets her advanced parole, which could be long. She will also lose any home leave benefits she may have (if in the YP program). There could be income tax filing issues as well - check with your consultant.

On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .
My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

The Congressional Hispanic Caucus has sent a letter to the President asking him to terminate the controversial 287(g) program that allows local police to enforce immigration laws on behalf of the Department of Homeland Security. The CHC expressed its concerns about allegations of serious civil rights violations against Hispanics as well as recent reports of poor oversight in the program. We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

My name is mistakenly typed in the form I-129 submitted to USCIS. In that form only, in all other forms(including i-129 supplements) it has typed correctly. So, it's reflecting in I-797 as venuKalangi(last/family Name), Venu((first Name). "venu" is repeated. My actual Name is Venu(first name),Kalangi(last/family name).
My petition is filed on apr27th'2010 and is in initial review now. Can you pls guide me what need to be done now. I'm a new applicant and my travel date is in last week of october. I heard that I need to apply for amendment, if so, by which form it need to be done and how much time it may take for correction or Can I go for stamping without amendment, is it causes any problem?

Right now they have not even done with July 2nd filers.
Also ppl whose applications have been transfered have not got any receipts.
About the 17th July, i think we should be atleast looking for minimum 15-20 business days.
I will request you to please concentrate on the September Rally. It will bring relief for all of us.

if the dependent is planning to come back on AP and then start working on EAD, does it mean the primary applicant has to work on EAD or the primary applicant can still continue on H1.

Two friends of mine were in the same situation.
In both cases dependent children were approved first, then primary applicant
(in one case in a 6 month after his dependent)
