ALL,

As expected this happened, but it happened sooner than expected.

This expected sooner because CIR was voted out in Senate and this was not thought about by this goverment.

Basically this was a close door arrangement between govt agencies which temporarily wanted to lower the friction by IV AND SIMILAR GROUPS.

BUT finally I believe this will come to a rest once we have new government next year.

Till that we are a tennis ball which can be tossed to any court.

PS: I dont even have I-140 and not even applied for one.

Where can i get photos for the Canadian visa. they have different specs. from the US pp photograph. I have already checked- Costco, USPS and the other stores.

I will change my employer in April and transfer my H1 with my wife's H4. My wife has found some company which would sponsor her H1B. I am on EB2+485 pending. My wife is on H4(we haven't filed her 485 due to retrogression). I am very confused now. Please help me!

1. My wife's company would apply H1B on April the 1st. My new employer will transfer our H1&H4 after that. Will we have any problem here?

2. My new employer would sponsor me EB1. I have EB2+485 pending. If I apply for EB1 140+485, what will happen my old 485?

3. I am thinking to apply 140 first and if 140 gets approved, I will file 485. I am not sure if I have any risk here. Is there any chance that my EB1 485 gets denied? Do my EB2 485 and EB1 485 have the same chances to get denied?

Hi,

My 6 yr H1B expires Dec 15,2009. I had applied for labor in 2008 and have received the case number for the labor dated June 26, 2008. My labor is not yet approved and online the status shows "pending". The company has not got any RFE against the labor. I dont know why its taking so much time. My main concern is, Can I apply for h1B extension on the basis of "Pending" Labor approval. What is the time frame to apply for an H1B extension? How long is the extension granted for ? 1 yr or 3 yrs....

Please advise ....

You should be able to work use EAD...your husband can still work on H1. First u need to apply for SSN to work.

My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

Hi,

I am stuck between H1B extn based on 6 yr and GC. My current H1B is expiring on 8th April 2011. I want to file for extn to recover my days outside US (about 60 days). Based on current processing time at Vermont processing center (6 to 8 months), I will not receive approval by end of 6 yr (about June 25th). My PERM was filed on 16-May-2011.

My company says it is not recommended to file for extn beyond 6 hr based on PERM pending if you already have H1 extn approval pending.

What are my options here to extend my stay beyond June 25th?

Hi,

I have an approved I-140 with my current employer. I have an offer from another employer that I am considering but the new employer will only transfer the H1B and not sponsor the GC.

Q1: Can I transfer my visa and start working for new employer and keep the GC process with the old employer if they agree to keep the offer open?

Q2: After visa transfer, if my PD becomes current, can I file I-485 with the old employer while working for the new employer?

I really appreciate any help.

Though I have started only one theread in last three years of my membership, I can't resist a temptation to start one now. From the following article in WSJ the lame duck session now appears certain and it is going to be in this month !!!!!!!!!!!!
The link does not require user ID and passowrd. I am late on sending my e-mails on housing crisis and emplyment based green cards. But I am going to do it right now. I urge all the members to do the same. Though I am not sure whther they will take up HR 5882 or any other relief language, no harm in hoping and praying.

Applied for LCA before H - 1 B renewal and got the error "FEIN ID NOT FOUND " error. I submitted additional documents still waiting for reply from DOL. Applied for LCA on august 5 , got the reply "FEIN not found" on august 13, faxed additional documents on same day still did not hear back from DOL.. Pls advice how long it will take now???????

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!

However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.

I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.

Does she need any visa interview after filing the transferring f1 to H4?

Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).
