If she gets J1 visa, then she would have to stay outside of US for 2 years at the end of J1 visa before she can get her greencard (even if you become citizen and apply for her). Another option would be that she would have to work in medically underserved region for 2-3 years to obtain J1- waiver, before she can apply for greencard.
None of this should affect YOUR greencard approval.

Do my employer need to file I-140 within 45 days of labor certification? Is this a law now?
It is part of a proposal to stop labor substitution. I hope it becomes the rule!

The CBO report DREAM Act advocates have been touting reflects a net plus of $2.3 billion against the federal deficit. But that's the SENATE version that was analyzed. If the antis are right and 2,000,000 people will benefit from DREAM, the House version's new $2525 in filing fees will mean an additional $5 billion will be raised. Why, it would be fiscally irresponsible NOT to vote for DREAM!

President Obama has selected three foreign-born scholars to serve on his Council of Advisors on Science and Technology (PCAST). The first of the three immigrants on PCAST is Mario Molina. Professor Molina, a Mexican native, is the winner of the 1995 Nobel Prize in Chemistry. It was awarded based on his discovering the threat posed by CFCs to the ozone layer. Professor Molina is a member of the Chemistry and Biochemistry faculty at the University of California, San Diego and the Center for Atmospheric Sciences at the Scripps Institution of Oceanography. He is also the Director of the Mario Molina...

I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.
Thanks much.

Hello everyone!
My wife has filed for my immigration and AOS around a week back. I would be expecting the biometrics appointment letter to arrive by the 25th of August. Now, I got a call from India yesterday informing me about my grandmother being admitted in the hospital, almost breathing her last. The doctors have all but given up.
My question here is whether I can go to the USCIS office with the doctor's letters and all the remaining proofs to expedite my AP well before my biometrics are done? If yes, what else would I require in terms of documents? I can just barely wait getting it done, but I dont want to leave without the AP document.
P.S.: I haven't yet received any NOAs.
Thank you.

America's Voice gives the rundown. A new analysis by the Drum Major Institute (DMI) found that the Comprehensive Immigration Reform ASAP bill introduced by Congressmen Solomon Ortiz and Luis Gutierrez late last year would "make the grade" for strengthening and expanding Americas middle class. DMI states the case succinctly: The Comprehensive Immigration Reform for Americas Security and Prosperity Act sets the standard for an immigration policy, which will boost our nations economy and strengthen and expand its middle class. The Institute administered a two-part "middle class test," which the bill passed with flying colors. The legislation was given a soaring...

From an email from America's Voice: Washington, DC Today, President Obama spoke at the Esperanza National Hispanic Prayer Breakfast in Washington, DC. The following is a statement from Frank Sharry, Executive Director of Americas Voice: President Obamas remarks today at the National Hispanic Prayer Breakfast show, once again, that he has a sophisticated understanding of how the elements of comprehensive immigration reform work together to solve this problem. He gets that being both a nation of immigrants and a nation of laws is necessary to create a legal immigration regime that works. While the President promised to enact reform...

String directory = "E:\\pic\\";
// assuming your textbox name is textbox1

Hi All,
I need some advise on my situation.
I am working in India and my H1B visa has been approved to work with a client in the NJ area. After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.
So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?
Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.
Please give me some advise.
Regards,
S

Hi Guys-
I am on H1B, working in US. I got my status changed from F1 to H1B last yr and never got it stamped ever since. I am going to get married next month in India and would require a visa stamp on my passport. I believe it is a straight forward process but would appreciate your experiences and suggestions for this.
1. I am planning to take visa appointments both for myself and my future wife togther at the Delhi consulate (ofcourse by paying separate fee). Can I do that here in US for both of us?
2. Once I get an appointment, we both should appear togther for the interview (for my H1B and her H4) . Right?
3. The forms 156 and 157 are required to be filled during the interview but not while taking appointments. Is it right?
3. I will take all my docs. along with our marriage certificate, and pictures from wedding. Do I need something extra to that?
Please suggest me any other important thing which I should be aware of in this process.
Thanks much!:)
