I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

I think it should be "lawful permanent resident". Someone with experience can answer better since I don't even have my greencard yet...:-)

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

It depends, on several factors inlcuding which service center it filed, is there any RFE or any document missing etc.
In ideal case it geenrally takes 4-8+ weeks.
If you want any fater within 2 weeks) you can file under premium prossing with addtional 1000$ fee.

Lawful permanent residents (LPR) of the United States (green card holders) need to keep their trips abroad to a relatively short period of time. The Department of Homeland Security (DHS) could determine that an LPR has abandoned their residence if the LPR’s intent was not to return to the U.S. within a relatively short period of time.

I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

Hi all,
I came to US on F1 student visa for Masters. After completion i had my OPT(from sep/1/2007 to sep/2/2008). My employer applied for H1 in april/08 and i got approved. So currently my status is H1 starting from Oct/1/2008.
Iam a consultant (Oracle PL/SQL developer) & i was on the project for a few months(from june/08 to august/08). Since august, iam on bench period and not getting paid by my employer & currently looking for a project!!!
My questions are;
1) How long can i stay like this on the H1 visa without getting paid or untill i get into a project; even though iam employed by the company and, are there any restrictions?
2) Will it cause any problem in future?
3) Also i have to go for the H1 stamping; any guidelines on tht?

My PD is 2005 and my I-485 was denied on the ground of my birth certificate and I got more proof from where I was born and submitted to USCIS and it was accepted in August 2009 and since then it has been more than a year and there is no update in the online status update for my I-485 application.
Lot of my friends from Late 2005 and early 2006 got the GC's last couple of months. I have requested my Lawyer to make a AILA inquiry? What else can I do at this point?
