Hi,
Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:
Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.
My questions are this:
1.) When I enter US back in with my AP in Jul 11, will that impact my H1B extension in any way.
2.) Without any EAD will I be Jeapordizing my AOS in any way.
I will be continuing to work with the same employer who is the sponsor of my current
I485.
Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

USCIS has announced revised filing instructions for numerous petitions, including its Form I-140 (Immigrant Petition for Alien Worker), Form I-130 (Petition for Alien Relative), and Form I-539 (Application to Extend/Change Non-Immigrant Status). The new forms instruct petitioners to file their applications at USCIS Lockbox facilities rather than at USCIS Service Centers.

I was curious if somebody has experience of H1b stamping in dominican republic?
I am planning to go there on a business trip, is it advisable to just go and get it stamped there or should I rather go to canada/mexico and get H1 stamped.
I looked at their website but it's not really very helpful.

My six-year H1B expires Feb 2 2010.
My employer (company A) filed PERM with DOL on July 30 2009.
I have spent a total of 2 months outside the U.S while on H1B status.
I have been on bench since July without paystub.
I am leaving the U.S on October 30 2009 and am interested in returning back
through another company
Can I return to the U.S through another employer (company B) on a new H1B visa after Feb 2 2010... How long would that visa be valid for.
If I cannot get a new visa; can I add the total of 5 months spent outside
the US on the current h1b visa for recapture through another employer (company B) after Feb 2 2010 -- return to the U.S; and then
subsequently apply for a 1-year extension after July 31 2010
based on company A's PERM filing.

Please help me with this. i came to USA on L1B visa in 2005 with 1 year petition and got extension for 2 more years i.e till feb 2008 but went to india for good in June 2007.
Again we came back with new L1B petition in Oct 2007 and got 3 years visa i.e, till Oct 2010.
1) Now if company apply for extension on L1B how many years ext i'll get?
2) Now if Company B wants to file new H1B for me, how many years of visa i'll get.
i was never on H1 before this is my first time H1B.
Please help me with this as soon as possible.

I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.
Pls who can answer 2 small questions:
1. Do I have a chance to work for this company?
2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

I got H1 this year. I was applied my ssn on oct 9 th. still i didn't get my ssn number. two days back ssn people called and told that "in online it is showing your EAd card. so we can give u ssn if you bring the EAD card". My question is if i give my EAD, will the h1 get cancelled. please suggest me.
Dont worry, showing EAD to SSA office will not cancel or invalid your H1B. Goto SSA office and tell them you have both H1B as well as EAD.

When an h1b transfer via regualr processing (california center) is pending...and say the person gets fired /layed off etc....
Can another h1b transfer be done with just the recepit notice and previous I-797?
What's the risk? Some companies are not willing to do premium processing even if the candidate is ready to pay the premium process fee.

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

AFAIK L1 counts towards that 6. So if you have done 1 on L1, 2 on H1, then you have 3 more years left on H1

Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.
My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?
Please answer this question so that I can take the needed action.

Your company's HR/legal should be able to give you an answer on how to reply to the NOF. I think they just have to show that they need you in the location that they put on application. Just make sure that EVERYTHING on applciation pertains to that same location - i.e market wage rates etc etc. If for some reason they do not have experience in these matters, try and get a hold of that NOF and go see a real lawyer. And word to the wise - be prepared to pay a little for the advice that you get. You always pay for what you get- so don't go to some 2-bit lawyer who will charge you $100 for answering questions when you can pay $200-$250 for someone who will give you worthy advice.

Do we need to make sure while filing H1 transfer, job duties on H1/LC should exactly match Labour Cert job duties?
I know while notifying it has to match.
